Terms of Service
These terms govern use of Notarus, including account eligibility, user content, subscriptions, acceptable use, the fingerprint and edit-history model, disclaimers, and the limits of what the product can establish.
Effective date: June 2026
Last updated: July 2026
These Terms are a binding agreement between you and Notarus LLC ("Notarus," "we," "us"). By creating an account or using Notarus, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 18 years old and able to form a binding contract. Notarus is an adult tool and is not directed to children.
2. What Notarus is — and isn't
Notarus is a personal record-keeping tool. It helps you create your own private, timestamped, tamper-evident records and organize them into reports.
Notarus is not a law firm and does not provide legal advice. Using Notarus does not create an attorney-client relationship. Notarus helps you keep a clear, credible record, but whether any record is admitted as evidence is decided by a court under applicable rules. We do not guarantee admissibility, the weight a record will be given, or any legal, financial, medical, or other outcome. Sobriety/BAC readings you log are self-reported and are not a medical or legal determination.
3. Your account
You're responsible for the accuracy of your information, for keeping your credentials secure, and for all activity under your account. Tell us promptly at support@notarus.app if you suspect unauthorized use.
4. Your content
You own the records and content you create. You grant Notarus a limited license to host, store, process, and display your content solely to provide the service to you. You are responsible for the content you record, including information about other people (such as your children), and you represent that you have any rights or permissions needed to record it.
5. The integrity model
You understand and agree that records are designed to be tamper-evident: each record is preserved with a cryptographic fingerprint of its content and its preservation time when saved. If you correct a record afterward, the correction is visibly marked as updated after its original preservation and the original fingerprint is retained — so the history of your record stays honest and demonstrable. You may delete records you control. You control your account as a whole and may close it at any time, which deletes your data as described in the Privacy Policy.
6. Acceptable use
You agree not to use Notarus to: break the law; record content you have no right to record; harass, defame, or invade the privacy of others unlawfully; upload malware; attempt to breach security or access others' data; or interfere with the service. We may suspend or terminate accounts that violate these Terms.
7. Subscriptions, billing, and refunds
Notarus offers a free tier and paid plans. Paid plans are billed through Stripe and, unless stated otherwise, renew automatically until cancelled. You can cancel anytime from your account; cancellation stops future charges and takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. We may change prices with notice; changes apply to future billing periods.
8. Intellectual property
Notarus, including its software, design, and trademarks, is owned by Notarus LLC. These Terms don't grant you any rights in our brand or software except to use the service as intended.
9. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that records will achieve any particular result.
10. Limitation of liability
To the maximum extent permitted by law, Notarus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or $100. Some jurisdictions don't allow these limits, so they may not fully apply to you.
11. Indemnification
You agree to indemnify Notarus against claims arising from your content, your use of the service, or your violation of these Terms or the rights of others.
12. Termination
You may stop using Notarus and close your account anytime. We may suspend or end access for violations of these Terms or to comply with law.
13. Governing law and disputes
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state and federal courts located in Jackson County, Missouri, and you and Notarus each consent to personal jurisdiction and venue there.
14. Changes to these Terms
We may update these Terms. For material changes we'll notify you in the app or by email, and continued use after the effective date means you accept the updated Terms.
